Present Managing Agent Joseph Chaffers - Present Members present – Wolfgang Haas, Roger Axt, Marce Humphrey, Faye & Ken Morley, Lynn Bomberger, Stephanie Lee, and Candace Pollock. 3.0 AGENDA REVIEW / RESIDENT REQUESTS – none 4.0 APPROVAL OF MINUTES – Motion by Jack Rugar, seconded by Diana Busman, to accept minutes from 9/20/05. Motion carries. 5.0 REPORTS 5.01 FINANCIAL REPORTS – Jim Ray advises no report. 5.02 WELCOMING REPORT – Jack Rugar reports Carol Rutherford is no longer performing welcoming activities and Lynn Bomberger has indicated a desire to do them (and has been doing them). Motion by Rugar, seconded by Grossman, to appoint Lynn Bomberger to the Welcoming Committee. Motion passes. 5.03 WEBSITE REPORT – Glen Grossman advises no report. 5.04 GARDENING REPORT – Written report submitted by Candy Pollock and Pat Bradley. 5.05 RULE COMPLIANCE REPORT – Diana Busman advises there is no report. 5.06 MAINTENANCE REPORT – Jack Rugar reports Ty Seeders from Granite Construction provided an estimate to redo the street for purposes of the Reserve Study. Ty also recommended a seal coat for $6000 to $8000 to preserve Glen Lake Drive. Joseph advises the work is subcontracted to Travis Bond. 5.07 LAKE REPORT – Jack Rugar reports the lake pump has been replaced. 5.08 WILDLIFE CONTROL REPORT – Jack Rugar reports four raccoons trapped. 5.09 ARCHITECTURAL CONTROL REPORT – Ken Morley reports unit #78 has an unsafe patio. There is a one inch lip, water flows toward the house, and Diane Hardcastle believed the problem has existed for a while. New owners are out of town. Grossman to seek legal advice from John Garvic as to whether or not maintenance of exclusive use area is the responsibility of the Association. Morley reports unit #50 received approval to install two solar tubes. Morley advised a copy of all committee approvals and indemnification agreements need to be sent to MCC. 5.10 AD HOC COMMITTEES: a. Document Revision – Glen Grossman reports the committee decided the weight limitation in Regulation E.2. needs to be eliminated because the Regulation is not being enforced and our insurance agent, Jeff Kane, recommends the Board delete the weight limitation if it is not going to enforce it. Committee motion to delete "none exceeding 40 lbs" from Regulation E.2. so that E.2. will now read, "With respect to dogs and cats, no more than a total of three per household." Motion passes. b. Disaster Preparedness Committee - Stephanie Lee will revise and update forms. Diana Busman recommends absentee owners leave a key with someone in case access is needed (e.g., to shut gas off)
5.11 NEWSLETTER ITEMS: 6.0 UNFINISHED BUSINESS 6.01 Reserve Study – Jim Ray reports he is waiting for Jack Rutherford to advise him on whether the Study from Barrera should be accepted. 6.02 Landlord Compliance with Rule C.2. (requiring names and phone numbers of tenants be provided to the Board) - deferred. 6.03 ANNUAL MEETING – Joseph to send out letter to the owners with date, time, and location of ANNUAL MEETING, and include proxies and list of candidates. 6.04 Chain Link Fence - Jack Rugar reports he received a bid from Abacherli Fence Company for $1700 and a bid from Peninsula for $4249. Motion by Rugar, seconded by Grossman, to accept the bid from Abacherli for $1700, subject to getting proper insurance documentation, to install 65 feet of fence. Motion passes. 6.05 Glen Heights Letter - letter from Access Association, managing agent for Glen Heights, stating that The Glen was not maintaining its trees, there were dead trees and dead branches which could damage property at Glen Heights, and that Glen Heights was willing to share the expense of an arborist. Rodger advises The Glen has spent $5400 on its trees this year and the only dead tree on the property is not located near Glen Heights property. This is really about their views and topping trees and we have been told not to top trees because that damages the trees. Rodger has drafted a response for Joseph to send. 6.06 Management Proposals - on hold for the new Board to address. 7.0 NEW BUSINESS – 7.01 Appointment of one or three independent 3rd party Election Inspectors - Rodger Axt, Faye Morley, and Lynn Bomberger are appointed Election Inspectors 7.02 Jeff Kane - The insurance broker for the Association, Jeff Kane from KBK Insurance, came and spoke at length. We have not had a claim on our policies since 2/24/01. Our casualty policy is with Travelers/St.Paul. Our deductible for property damage is $5,000. There is no deductible for liability claims. Typically one claim will not effect the premium. He believes individual unit owners are responsible for interior damage so every unit owner should purchase an HO-6 policy to cover the interior of their unit. Coverage A should be at least $50,000. The best policies have loss of use coverage because in the event the occupant must vacate the unit (e.g., tenting for termites), the Association is not responsible for providing the occupant with lodging. He believes the Association would have liability if we do not enforce the weight limit on dogs and a dog exceeding the weight limit injures someone. It is better not to have any weight limit than to have a weight limit which is not enforced. St Paul does not ask about dogs but many HO-6 insurers do and specifically exclude coverage for certain breeds. He has seen rules from other associations prohibiting renters from having dogs. Our Earthquake Insurance is for $9 Million with a 25% deductible per building. We have no insurance coverage for landslides. Flood insurance will cover landslides (but we are not in a flood control district). A rock slide resulting from an earthquake is covered under the policy; a rock slide resulting from excessive rain is not covered. He could not tell from our current CC&Rs whether the Association would have to cover damage to party walls. That is another reason why unit owners should purchase HO-6 policies. He will get us a quote for raising our casualty coverage from $3 million to $5 million. It should cost less than $1000 per year; rates are coming down. 8.0 CORRESPONDENCE – 9.0 FUTURE BOARD MEETING / ADJOURNMENT – 11/15/05 following the ANNUAL MEETING at the Forest Grove HOA Clubhouse, Forest Lodge Road, Pacific Grove, CA.
